1. Acceptance of these terms

By accessing or using the ADHD Telemed website (the “Site”) or any service we offer (the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Site or Services.

2. Who can use ADHD Telemed

To use our Services, you must be at least 18 years old (or have a parent or legal guardian consent for minors aged 13–17), reside in a U.S. state where ADHD Telemed is licensed to provide care, and have the legal capacity to enter into a contract.

3. Not a medical emergency service

ADHD Telemed is not designed for medical emergencies. If you are in a medical or mental-health crisis, call 911 immediately. If you are in suicidal or emotional distress, call or text the 988 Suicide & Crisis Lifeline.

4. The clinical relationship

The use of the Site does not, by itself, create a doctor–patient relationship. A clinical relationship is formed only when (a) you complete an intake, (b) we accept you as a patient, and (c) you attend your first evaluation visit with one of our licensed clinicians.

5. Screeners are informational

The screeners and self-assessments on the Site (including our free ADHD test) are educational and informational. They are not a substitute for professional medical advice, diagnosis, or treatment. Only a licensed clinician, through a comprehensive evaluation, can diagnose ADHD or other conditions.

6. Fees and billing

Fees for evaluations, follow-up visits, and medication management will be disclosed before service is rendered. We accept insurance from the carriers listed on our Insurance page; we also offer transparent self-pay rates. You are responsible for confirming your coverage. Missed-appointment and late-cancellation fees may apply per our then-current cancellation policy.

7. Prescriptions

Whether to prescribe — and what to prescribe — is solely a clinical decision made by your physician. We do not guarantee that any patient will be prescribed any particular medication. We follow all applicable federal and state laws governing controlled substances, including telehealth prescribing rules.

8. Acceptable use

You agree not to: provide false information, impersonate another person, attempt to access another patient’s records, use the Site for any unlawful purpose, scrape or reverse-engineer the Site, or interfere with the integrity or security of the Site.

9. Intellectual property

All content on the Site — text, graphics, logos, software — is owned by ADHD Telemed or its licensors and is protected by intellectual property laws. You may not reproduce, modify, or distribute Site content without our written permission.

10. Disclaimers

The Site is provided “as is” without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted or error-free. Medical information on the Site is general in nature and may not apply to your individual situation.

11. Limitation of liability

To the maximum extent permitted by law, ADHD Telemed and its providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site. Our total liability for any claim shall not exceed the fees you paid us in the twelve months preceding the claim.

12. Governing law and disputes

These Terms are governed by the laws of [your state of incorporation]. Any dispute arising out of or related to these Terms shall be resolved through binding arbitration on an individual basis, except where prohibited by law.

13. Changes to these Terms

We may update these Terms at any time. Material changes will be communicated via email or a prominent notice on the Site. Continued use of the Services after changes take effect constitutes acceptance.
